Legislative Decree 33/2013 – Article 39 – Transparency of territorial planning and governance activities
1. Public administrations publish:
a) territorial government acts, which, among others, territorial plans, coordination plans, landscape plans, urban planning tools, general and implementation, as well as their variants;
b) for each of the acts referred to in letter a) are published, promptly, the draft measures before they are submitted for approval; adoption or approval resolutions; the relevant technical annexes.
2. The documentation relating to each procedure for the presentation and approval of the urban planning transformation proposals of private or public initiative in variation to the general urban planning instrument however called in force as well as of the urban planning transformation proposals of private or public initiative in implementation of the general urban planning instrument in force which entail building rewards in exchange for the commitment of private individuals to carry out extra-cost urbanization works or the transfer of areas or volumes for purposes of public interest is published in a specific section on the website of the municipality concerned, continuously updated.
3. Publicity of the documents referred to in the paragraph 1, letter to), it is a condition for the acquisition of the effectiveness of the acts themselves.
4. The detailed regulations provided for by current state and regional legislation remain unchanged.
